These Terms and Conditions constitute a legally binding agreement made between you (“User”, “you”) and Blydex (“we”, “us”, or “our”). By accessing the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and all applicable South African laws, including the Consumer Protection Act 68 of 2008 (“CPA”).
2.1 Directory Service Only: Blydex provides an online venue and directory service to facilitate connections between Users and independent Law Firms (“Firms”).
2.2 No Legal Advice: Blydex is not a law firm. We do not provide legal advice, opinions, or representation. No information on the Platform should be construed as legal advice.
2.3 No Attorney-Client Relationship: Use of the Platform or sending a booking request does not create an attorney-client relationship between you and Blydex. Any such relationship is formed solely between you and the Firm you engage.
2.4 No Endorsement: The listing of a Firm on the Platform does not constitute an endorsement, recommendation, or guarantee of the Firm’s qualifications, competence, or quality of service. Users are encouraged to conduct their own due diligence.
3.1 Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately of any unauthorized use of your account.
3.2 Data Processing: In accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”), Blydex collects and processes your personal information to facilitate your booking requests. By using the Platform, you consent to the transfer of your inquiry details to your selected Firm.
3.3 Third-Party Conduct: Once your data is transferred to a Firm, that Firm becomes the "Responsible Party" for that data. Blydex is not liable for how a Firm handles or stores your information once it has been transmitted via your request.
4.1 Non-Binding Requests: A booking request submitted via the Platform is an inquiry only and does not bind the Firm to accept you as a client.
4.2 Fees and Billing: Blydex does not handle legal fees. All financial arrangements, fee agreements, and mandates are handled directly between you and the Firm.
5.1 Total Limitation: To the maximum extent permitted by law, Blydex, its directors, and employees shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from:
The conduct, advice, or negligence of any Firm listed on the Platform.
Any errors, omissions, or inaccuracies in the information provided by Firms.
Platform downtime or technical failures.
5.2 Indemnity: You agree to indemnify and hold Blydex harmless from any claims, losses, or legal expenses (including attorney-and-client costs) arising out of your use of the Platform or your breach of these Terms.
All software, trademarks, and content (excluding User-submitted data) are the exclusive property of Blydex. You are granted a limited, non-exclusive license to use the Platform for personal, non-commercial purposes only.
You agree not to use the Platform to:
7.1. Submit fraudulent or malicious inquiries.
7.2. Scrape, data-mine, or harvest information from the directory.
7.3. Post defamatory or infringing content.
Blydex reserves the right to suspend or terminate your access to the Platform at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.
These Terms are governed by the laws of the Republic of South Africa. You consent to the exclusive jurisdiction of the High Court of South Africa in respect of any disputes arising herefrom.
